Accused for Theft David McGrath Receives Cold Foot From Los Angeles Neighborhood Council

   Did elected by fraud, former CCV HOA Board president, David McGrath, use any Cross Creek Village HOA money to purchase a Down Town Hot Dog Restaurant called  Weeneez at 500 S. Spring Street, Los Angeles?

Did Brian Martin help him steal Homeowners money? Did Janice Meldola help David bring in his vendors to overcharge our HOA so they can collect kickbacks? Those two (Martin and Meldola) allegedly helped David harass CCV owners they did not like. They also voted to allow David to violate HOA Bylaws by allowing him to keep his ugly red sofa on his balcony. They also changed the Election Rules to allow themselves, and not the voters, to chose who is going to serve on the Board. In the same time this "gang" of power hungry board members, who support each other's positions on the Board, fined others indiscriminately, as part of their vindictive agendas against residents who opposed their abuse.

Using HOA founds, for their own purpose, they printed and distributed fraudulent flayers and used security guards under their control to post them all over the complex. McGrath reportedly terrorised 75 yr old HOA manager with antisemitic emails. McGrath also threatened violence against certain HOA members who spoke with foreign accent. McGrath used HOA money to pay his lawyer, Raymond Szu, to defend him from multiple Restraining Orders. And who came as his "I will say anything" witness!  BRIAN MARTIN!

Those two helped McGrath intimidated, fine and harass residents arbitrarily and allowed David to allegedly sexually harass janitorial employee of Hispanic national origin. It was reported in Media that this reported "thief", David A. McGrath, who in the dead of the night broke in  THE MUST restaurant and took over $100K worth of possessions of others, changed Weeneez's name to Stray Cat Cafe and gave the Police wrong last name to conceal his identity in their crime investigation. Guess who his lawyer is in this case? Raymond Szu; The same lawyer the HOA use and pays legal bills!

Lets review some known facts. Prior to joining the HOA Board, in Summer of 2009, this prolific trouble maker was driving a beat up Honda Civic with a busted up front bumper.  David the gambler, as he was also known at Cross Creek Village was constantly crying how deep in debt he was.  After he got on the HOA Board and after he was assisted by two of his close cohorts, Brian Martin and Jen Meldola (read about those two below), David brought in to fleece us, all his "overpriced vendors", against the HOA CC&R's and our By Laws, including his buddy janitor who did not have a company, let alone a required valid license! 

With help of Brain and Meldola, David also hired Ronald Culver who still fleeces the HOA using his buddy HASS Construction, Inc and collects unreasonable "supervising fees".

Barely an year after he managed to get on the HOA Board, David McGrath, the destroyer of  THE MUST restaurant and the defendant in the lawsuit for theft, managed to pay over $200,000 for Weeneez Hot Dogs restaurant! 

Cross Creek Village HOA members, if not from CCV member's paid HOA dues and vendors kickbacks , where did so much money come from all of the sudden? We believe that with help of Janice Meldola, HOA treasurer, McGrath utilised his access to CCV bank accounts and kickbacks from overpaid vendors, which he hired at above the market cost in exchange for  what else if not kickbacks? Stingy as he is known to be, McGraht never to our knowledge ever overpaid anyone who worked at his house so why is he, with the help of  Janice and Brian, overpaying vendors under his control?  If you have different explanation, please write to CCVAlliance@Gmail.com !

Accordingly, David McGrath is now sued for POSSESSION OF PERSONAL PROPERTY, THEFT, CONCEALMENT, CONSPIRACY, INTENTIONAL INTERFERENCE WITH ECONOMIC ADVANTAGE, NEGLIGENT INTERFERENCE, which is self-explanatory. [See LA County Superior Court Case# BC441922 - Reads more below].

In February 2011, the LANC Board members denounced McGrath's trick/s and ruled against David's repugnant "middle of the nights" braking and entry in THE MUST restaurant. To give him a message that his bad acts will not be tolerated.  The City's Board properly turned his request for liquor license down  to protect the members of the Los Angeles Down Town Community.

Nevertheless, thanks to reckless support of JAN MELDOLA, BRIAN MARTIN and SANDRA KRADEN, Cross Creek Village members end up paying "inflated prices" for the construction work done by McGrath's ["Captain Steal some stuff in the middle of the night"] choice of vendors, such as Architect Ron Culver, and his construction vendor HASS Construction.

The inflated prices paid was EVEN MORE  then what we paid to certifiably bad HOA manager "Neda Firouz's connection", the shoddy contractor ETAN BINO;  Thanks to Brian Martin and Janice Meldola, the corrupted HOA Board paid $66,000 for repair of the staircases, which multiple reputable contractors offered to fix  for $30,000 and this borders criminal! Clearly, we the homeowners are the victims of the Board Members' Ripoff and are entitled to compensation in the amount of damages such negligent hiring had caused us.

As mentioned above, we believe that David McGrath purchased the share of the "Stray Cat Caffe" from Julie Ricco in Down Town Los Angeles, using  our HOA money filtered out of the massive spending on overpaid construction including flat out ugly metal handrails mounted on top of the wooden handrails. Did you ever see such UGLY and UNNECESSARY addition in any decent HOA complex? NO!

The HOAMcGrath's vendors are hired illegaly without a signature of the HOA Secretary Masao Kitamura. Kitamura, who rarleyl came to Board meetings refused to sign those for a good reason.

There is overwhelming evidence that McGrath caused harm detriment of the HOA members. From hiring his buddy Janitor who didn't even have a company at the time of the hiring oto his gambler lawyer friend Raymond Szu, David brought in one by one his buddies as vendors to tap the HOA accounts.

"Approximately 20 members of the public turned up to oppose McGrath's plans, with most speakers citing the manner in which McGrath gained possession of the bar space as their primary objection."

Sara Jones said: "Based on several documents that were made public about the whole Must issue that were passed out during the meeting, it would be hard for David McGrath to get any support from DT residents."

Casey said: So basically, of the entire council, only one person thought that Captain "Steal some stuff in the middle of the night" should be allowed to sell alcohol at this location ( I will not mention this person's name).  Everyone else either stood up firmly against it, or said they would NOT endorse it. The endorsement is what he (David A McGrath) was asking for.

Cross Creek Village HOA is also sued because of  David McGrath , Brian Martin and Janice Meldola. Because of them, the HOA is likely to accrue future loses and suffer perils we don't deserve.

David and his group (Brian Martin, Jan Meldola and Sandra Kraden) are not the people we can or should trust  to handle our HOA money! 

DAVID A. McGRATH EMPLOYS FRIENDS IN VIOLATION OF CCV POLICY !!

David A. McGrath.... AGAIN! A credible new report came from the source close to CCV office alleging David A. McGrath is up to his old tricks and has LIED AGAIN to CCV homeowners in November 2009 Newsletter, where he said:

“Effective immediately, I have instituted a moratorium on spending; exceptions are allowed for life safety issues and emergencies.”

THIS IS NOT TRUE!  Right at that time, David engaged HOA in a unecessary new lawsuit, which cost the association a ton of money, thanks to his personal vendettas.   -  "Inasmuch that David defies all of us, and is abusing the office (e.g. by hiring and signing contracts with friends in violation of CCV Policy and Bylaws, without countersignature of the Board's Secretary), David McGrath lacks the authority to “institute” anything without the Board's approval. " - Says received Report!

To circumvent our Bylaws, David acts perfidiously Behind the back of the Board and has stepped up check writing to an attorney (Raymond Szu) with whom, we heard, David made a deal to have him support his vendettas at homeowner's $$$. "This is inappropriate David McGrath, you must STOP abusing the office . STOP bringing in and overpaying your friend janitor ...what's his name, Chris?", David  was recently admonished in public.  - In November and December alone David aranged the payments to Raymond Szu, in the $14,000 range, asking him to file costly motions, which is the same type of  squandering Pat Smith was doing with Adrian J Adams, Esq !!!- IF we are to recover, we cannot have dishonest Board Members bringing buddies to work here, and that’s what David is seemingly doing by overpaying friends to get them to share some profit with him.

Fact that these checks were issued without proper Board approval duly raises very serious concerns.  Why is HOA treasurer going along with this inaproriate act? If this is true, the Board have lost control of our money and is letting check holders write the checks to whoever and whenever they wish, without deliberating underlining issues and voting to legitimize each of the new expenditures, which is the legal standard.

We urge the Board to STOP DAVID'S ABUSE and investigate his habit of hiring friends as vendors and check writing practice to same people, which in order to get on our payroll, David allegedly missrepresented as "Cheep" to the Board of directors !!!

It is interesting how people have double standards and are not even ashamed about that. Several months ago our treasurer was very adamant about firing Dana, our office assistant because she was less then truthful … OK , the lady lies so what? You are seating on the Board with the big liar and you are not bother with that… please explain, dear Lady Treasurer, why do you have “double standards”?

Mark is right! David and his cosigner could and should be held responsible to return our money to the association's bank account, if in fact, it is determine that payments they initiated did not come with proper approval of the Board of Directors and that is what we were informed.

Q: Why did David need to lie to us and other Board Members?
A: Because he desperatly wants to be recognized as a leader he is not capable of being because he lacks knowledge, experience, and credibility, for starters.

Q: Why is he called: "MAN WHO LIES A LOT" ? 

A: Because David McGrath's PERFIDIOUS CHICANERY posing, and sharp practice goes well beyond the bounds of legitimacy. What David is good at is conning and convincing people he is something he is NOT.

Q: HOW DAVID McGRATH TRICKED HOMEOWNERS?
A: According to few first hand witnesses, David McGrath went door-to-door to hustle residents to sign his predated proxy. The objective of this "sharp practice" was (1) to block the other Board candidates  from obtaining signature from the same person on a later day, which would invalidate David's proxy, and (2) to cheat election director into believing the proxy was signed on the day of election.

Q: What are David's Motives and Intention Behind Such Practice?
A: According to his “former friends”, which he deceptively used to further his purpose, David became very excited when he learned that Neda Firouz was skimming substantial amount of money in cooperation with her contractor BINO, and Board President Madeleine Short and Pat Smith. Instantly, when he recognize how easy was for Neda to steal from HOA David's eyes glared and he proclaimed “ I want to be the Board President”. For months thereafter David went relentlessly door to door, luring homeowners into giving him support on false pretexts. In his words, he “never took his eyes of the ball”.

Q: So, what Hollywood Casino Cheff David A. McGrath wants is his hands on our money, right?

A: Think for a moment, - why would a man in Financial Distress and whose mortgage is in "upside down" possition want to "fight like a tiger" for a non paying job? It doesn't make any sence untill you put into equation that position comes with control of  HOA's $2.5Mill budget, which in good part goes on contractors who are gratefull for the job, thus the kick-backs! The only logical answer  why David wants to "work for free" when he needs money is because he hopes he will gett some and no one will knows.

Q: Does David A. McGrath have a job?

A: Apparently,Taro hired "talented" Chef David McGrath some years ago and he sees to it that the gambling patrons are well-fed with tableside service for breakfast, lunch or dinner 24 hours a day!  Never the less, David admits he gambles a lot with his girlfriend Margarete Santoro and as usually happens, "lady luck" is not a very "loyal girl". Gamblers tends to lose a lot of  money. So, it is reasonable to assume that his Financial woes are only exuberated by such unhealthy habit. As such, David is logical threat to HOA and our accounts.

Q: Was Mr. David McG... (?)  a CCV Allinace member?
A: Yes, he was at some point, but since he was doing bad things and was giving "the allianace" the bad name he got  kicked out! This engered David very much.  This when David begun lobbying his first door neighbours,Victoria Dolceamore and Jen Meldola to become his "Group" by badmouthing other alliance members.

For the record: "The Alliance" looks after the best interest of all homeowners. Since David didn't care about  anything else but his own interest and how to get in power, we did not want to be associated with him. .

... CON-TROLLING FOR KICKBACKS!

Q: How he plans to  pilfer our money?
A: David admitted to having a plan to copy "How to Steal" Neda Firouz blueprint. David's plan was to start changing vendors as soon as he gets on the Board of Directors,  in hope that new vendors will offer him kick-backs. This appears to be all David wants and needs in order to recuperate his investment in down payment before his up side down mortgage is 'dumped" and befree he moves out closer to his job in Inglewood, where rents are more affordable.


Q: DID DAVID LIE IN HIS ELCTION BIO?
A: But of course he did, 'selling' is David's forte: Election Bio Lie No 1: Many beleive that David  misrepresented to homowners that he holds "degree in business administration" from FU (Florida University) but when we asked him to show his diploma, he would NOT.  Earlier, David admitted that he first attended PSTS ("Philadelphia School of Tough Streets ").. and then he went to a school for "COOKS".

Election Bio Lie No 2: David lied when he said he has “twenty years of experience in managing luxury hotels and casinos”.

Election Bio Lie No 3: David said  he manages “thousands of employees”, which is... you guessed right ...nothig but the "hot air" and delusion David McGrath is full of, once you get to know him!

When questioned recently, David McGrath admited to Insurance investigator that he was Born May 9, 1972. If Born in 1972 David was only 17 twenty years ago! Now, how many of you do really believe David was a “luxury Hotel Manager” at age of 17?

Yes, the conclusion that he LIED is there, thus the nick “MAN WHO LIES A LOT”!  - Bottom Line: We ask David to apologize to CCV homeowners by RESIGNING IMMEDIATELY. We need this to prevent possible damage to the association.

Q: Did David McGrath really threatened to shoot Guard Jackson for removing his flyers?

A: According to an eyewitness - Yes, David threatened Security Guard Jackson in February 2009 and then caused Cross Creek Village Security Guard Jackson to be transferred after storming into security office and flat out threatened to shoot him at his place of work for removing his flyers posted all over the complex.

Concerned Cross Creek Village Residents AVOID David McGrath because he owns guns and has threatened to shoot people with his hand gun/s.

HARASSMENT OF VENDORS: HOA minutes show David also harassed our accountant Mr. Tevlin. David  is not a person we need on the HOA Board. He first cheeted us to get on Board and now that he is on the Board he is now abusing power and is wasting OUR MONEY to keep advanicng his personal agenda.

To imitate Pat Smith and Neda Firouz, David apperently hired his own lawyer harasser to harass residents who flat out don't like David and who think and share the opinion that David is a CROOK and the liability for the complex, which the Board must eliminate ASAP. 

Q: Is it true that David A. McGrath likes to manufacture FRAUDULENT DECLARATIONS to hurt his oponents and that he even worked with Adrian Adams, Esq, his own declared enemy, and Adams' "side-kick" Karen Nagad, Esq, on prepairing a fraudulent declaration that helped admitted vandal Tracy Templin stay employed at Cross Creek Village after he ruined two of the resident's cars!  

A: Yes! Very Imoral Person, David  A. McGrath declared many times to hate Adrian J. Adams, Esq and his sidekick Karen Nagad,Esq and Neda Firouz. But then, because he evidently hate more and more people, and when it serves his own purpose he works “hand in glow” with his enemies to hurt his enemies. These who know David reportedly think he is a "smooth talking menace with no scruple", who only seek to satisfy his own needs. - Just read all the posted comments!

False Testimonies: David also admitted to testifying falsely against Food and Beverage Union Workers (FBUW) on behalf of his employer so he can get few extra benefits for hiself, out of his employer on expence of poore worker who is to be hired based on David's LIES! 

Stealing: David Admits to take kickbacks from Hollywood Park beverage vendors who service Inglewood Casino. If he takes kickbacks from these vendors why should we assume he will not do the same here at Cross Creek Village vendors?

All the Honest Board Members who does not intend to collaborate with David into secureing themselves a snug and unassailable position from which they can work "hand in glove" with vendors to their mutual financial benefit, MUST WATCH David and must inform each vendor that CCV HOA does NOT allow kick-backs!

ONE MUST KEEP IN MIND that David is master in conning people. His forte is to convince you that he is your “buddy” so he can use you for his own purpose  - We remember how he used nice homeowners like Lucy Cho to help him post flyers all over the complex and then when he did not need her anymore he dumped her and ignored her. - Everyone who trusted David once ended up disappointed!

David AGAIN signed a fraudulent declaration in the Restraining Order case against crack using HOA maintenance worker Tracy Templin, who admitted to vandalizing resident’s vehicles in HOA's upper B garage on behalf of CCV former manager Neda Firouz. MARK MONTGOMERY – NEW CAI TRAINED MANAGER BRINGS "70's STYLE" TO CCV

After unsuccessfully trying to replace all their vendors and after causing ongoing turmoil on the Board of Marina Pacifica HOA (Long Beach, CA) Mark Montgomery 'resigned' to avoid being FIRED.   (Please also note that allegedly, office stuff Jessica P. was getting ready to seeing lawyer because Mark Montgomery was harassing her daily to persuade her to quit her job - what a ruthless charachter!)

 Mark Montgomery got hired by Cross Creek Village curtsey of brigand attorney Adrian J Adams, Esq, who besidees of being a 'Esq' runs an  'Jobs for Managers' web site. (Click on the link to see it) Apperently Adams directed his subordiante Pat Smith, a shamless women, who is known as his 'cuppler' and Jonathan Kolkey who got no mind of his own, to give Mark the job regardless of his reputation.

For these of you who are not familiar with this Cross Creek Village ominous character, please be informed that among other things Adrain Adams did unethically, for the sake of making profit, was his ongoing support for CCV corruption. The previous Board who followed his corrupt instructions also paid Adams' shamelessly over $100,000 of our money, primarily for the service of harassing residents (e.g. Pat Smith, Kolkey and Peltomaa’s political opponents) who despised Pat Smith’s apparent “cappler” type of employment with Adrian Adams and her kick-back deal with BINO, which means she (and her cohorts)was getting percentage of each 'legal' bill Adams and BINO submitted to Cross Creek Village.

After changing three jobs in little over a year, and after lasting only 10 (or so) months at the Marina Pacifica and after allegedly being fired by previous employer ("PCM Management") , Mark Montgomery came to Playa Del Rey, CA in hope he can bamboozle members of Cross Creek Village! Not so FAST buddy!

 This CAI Trained veteran's alleged reputation is that he is TROUBLE MAKER" and a "HE CANNOT TELL THE TRUTH" (just like Pat Smith and David McGrath), we was told.

CCV BOARD MEMBER BARRY L. EDWARDS AGGRESSIVE AND THREATENING BEHAVIOR

On May 19, 2009 Sandy “the Shouter”, Patricia "Pat" Smith and “Nasty Nina” Peltomaa – deliberated in secrecy and choose to hit us with new $251,37 special assessment. The current Board's clique of four did that after clearly promissing to us time after time and meeting after meeting there would be no new assesments. Like many times in the past, they lied to us to us to stay in power and to avoid being recalled, which is what almost 50% of the voters realy asked for!

Jonathan Kolkey, Patricia Smith, Nina Peltomaa and Sandy Kraden lied to us and they lied knowingly and repeatedly. When Board member Gerry Brace in line of his Board's duty questioned the legality of such behind-the-scene decision and asked who is authorizing payments of tens of thousands of dollars to Adrian J Adams ESQ for bogus "legal" work of "fixing" General Ledger and to bully assertive homeowners and political oponents on behalf of the four mentioned directors, without full Board’s knowledge and approval, the new Board BULLY Barry Edwards jumped quick from his seat and reached over the table in an apparent attempt to grab Gerry Brace and hurt him. Dear Barry Edwards, that is unaccepatble!

What is a bully? It is someone who takes advantage of another individual that he or she perceives as more vulnerable. The goal is to gain control over the victim or over the bully’s social group, which in this case is "The Kolkey Clan".

Barry Edwards moved to Cross Creek Village in May 2008. He quickly got involved with highly unpopular HOA manager Neda Firouz who hopped to have this young and naive combat trained soldier chaise away everyone who question her obvious mismanagement of complex and our funds. With Firouz's help Edwards got “inserted” on the Board where he quickly begun bossing people out and showing his aggressive nature. During May 19, 2009 Board meeting, Barry threatened Gerry Brace and attempted to fight this gentlman outside like this was Mazary Sharif or Kamp Nuthouse or similar. In front of the witnesses Barry Edwards was heard shouting: “Lets get to the shed and I show you who is right”.

In the next moment the brave soldier Barry L. Edwards was now seen threatening half of his size senior citizen. Barry L. Edwards agressive posture, body language and shaking of fist at 74 year old resident Peter Bruner did not leave anything to one's imagination. If there was no people stopping Berry in between, Barry would almost certainly assault both Gerry and Peter. Big and strong women Nina Peltomma was instrumental in stopping out of control Barry Edwards. She grabed and pulled him down to prevent fighting. Later, "NASTY NINA - A.K.A. THE TREASURER" lied with no shame saying "nothing happend". This clique of four power grabers has no credibility and cannot be trusted. As we learned earlier, Kolkey Clan's key member and money handler Nina Peltomaa lack knowledge and integrity and is someone who we cannot trust with our checkbook!

Many believe that Barry’s sense of reality and emotional control may have been negatively affected by his combat routine to engage and terminate enemy. If this is the case, Mr. Edwards should be perceived as very dangerous, should seek professional help and enroll in anger management program or similar.

The reason why unelected board member Berry Edwardsfeels free to threaten peaceful Board member Gerry Brace and homeowner Peter Brunner is because Berry is programmed to hate/dislike certain people. WHO programed Barry Edwards? "NASTY NINA PELTOMAA", PATRICIA "PAT" SMITH (6yr on the Board) and, "shouting miracle from building C" SANDY KRADEN, Barry's Cross Creek Village HOA Board "Commanders".

These three treacherous women are outright troublesome! Everyone who lived here for sometime knows that these three acting as clique remain on Board only by interfering and blocking the good guys' ability to be elected and to serve this community. For this and other good reasons SANDY, PAT and "NASTY NINA" should not be reelected. Let them invite their harasser friend "lawyer" Adams to their homes and offer him to help himslef to their personal founds, NOT OURS!

SANDY, NINA and PAT SMITH manipulation and programming of naive combat trained military man Berry Edwards as their boogie-man is flat out outrageous.

These three dangerous women are often seeking upper hand over other homeowners by employing other known bully, harasser and intimidator of homeowners Adrian J Adams ESQ at $300/hr. PATRICIA, NINA AND SANDY don't care what it cost, it's NOT their money - IT"S YOURS! At last,they now use a military trained Bully Barry L. Edwards who apparently got on his hands some serious anger management problem.

Berry Edwards is asked to keep distance and stay away from Board member Gerry Brace's and Peter’s residence and their place of work. Because of his unaceptable conduct Barry L. Edwards is asked to resign his Board position. Under no circumstance CCV Board position is to be held by an Physical and Highly Aggressive Bully who thretens 70+ seniors in our peaceful community.

Mr. Edward’s behavior is closely watched. If he doesn’t comply with this instruction, threatened parties will seek TRO against him - a court issued restraining order to shore Mr. Edwards’s aggression. Furthermore, his superior at the military might be contacted in search for a peaceful resolution. Residents are also encouraged to report any further incidents involving Barry L.
