DAVID A. McGRATH EMPLOYS FRIENDS IN VIOLATION OF CCV POLICY !!

David A. McGrath.... AGAIN! A credible new report came from the source close to CCV office alleging David A. McGrath is up to his old tricks and has LIED AGAIN to CCV homeowners in November 2009 Newsletter, where he said:

“Effective immediately, I have instituted a moratorium on spending; exceptions are allowed for life safety issues and emergencies.”

THIS IS NOT TRUE!  Right at that time, David engaged HOA in a unecessary new lawsuit, which cost the association a ton of money, thanks to his personal vendettas.   -  "Inasmuch that David defies all of us, and is abusing the office (e.g. by hiring and signing contracts with friends in violation of CCV Policy and Bylaws, without countersignature of the Board's Secretary), David McGrath lacks the authority to “institute” anything without the Board's approval. " - Says received Report!

To circumvent our Bylaws, David acts perfidiously Behind the back of the Board and has stepped up check writing to an attorney (Raymond Szu) with whom, we heard, David made a deal to have him support his vendettas at homeowner's $$$. "This is inappropriate David McGrath, you must STOP abusing the office . STOP bringing in and overpaying your friend janitor ...what's his name, Chris?", David  was recently admonished in public.  - In November and December alone David aranged the payments to Raymond Szu, in the $14,000 range, asking him to file costly motions, which is the same type of  squandering Pat Smith was doing with Adrian J Adams, Esq !!!- IF we are to recover, we cannot have dishonest Board Members bringing buddies to work here, and that’s what David is seemingly doing by overpaying friends to get them to share some profit with him.

These are the checks (miss)used for that purpose:

Fact that these checks were issued without proper Board approval duly raises very serious concerns.  Why is HOA treasurer going along with this inaproriate act? If this is true, the Board have lost control of our money and is letting check holders write the checks to whoever and whenever they wish, without deliberating underlining issues and voting to legitimize each of the new expenditures, which is the legal standard.

We urge the Board to STOP DAVID'S ABUSE and investigate his habit of hiring friends as vendors and check writing practice to same people, which in order to get on our payroll, David allegedly missrepresented as "Cheep" to the Board of directors !!!

Please email the alliance the check numbers and amounts paid to David's vendor Chris (janitor)!!.  - David and the Board treasurer could not be reach for comments. Nevertheless, both of them are invited to post  here or send email to explain this alarming behavior!

It is interesting how people have double standards and are not even ashamed about that. Several months ago our treasurer was very adamant about firing Dana, our office assistant because she was less then truthful … OK , the lady lies so what? You are seating on the Board with the big liar and you are not bother with that… please explain, dear Lady Treasurer, why do you have “double standards”?

Mark is right! David and his cosigner could and should be held responsible to return our money to the association's bank account, if in fact, it is determine that payments they initiated did not come with proper approval of the Board of Directors and that is what we were informed.

TRACY TEMPLIN – ROOFTOP “NINJA ASSASSIN” CAUGH IN HATE CRIME ACTION:

We are deeply saddened to inform you about an ongoing campaign of criminal harassment and intimidation in Cross Creek Village sponsored by HOA manager Neda Firouz. This is apperently done with FULL KNOWLEDGE of Board members PAT SMITH, JONATHAN KOLKEY, NINA PELTOMAA and SANDRA KRADEN.

It is reported that clique holding all CCV power has conspired undemocratically to smear and attack every "oponen" who question their large sums of money "squandering" practice... To keep their "unpaid" jobs, the Board members fight like tigers and are rigging the BOARD RECALL using our money ofr deceptive mailers, smear and defamation.

Tracy Templin. This picture was apparently taken just as he got on his knees ready to strike again at the same victimes. Reportedly, this time he 'just' throw trash/dirt on their balcony and intimidated homeowner/s in front of their minor kid, demanding rudely from American Citizens to "fu..ing go back to thier country of origin”. The Cross Creek Village Board President Jonathan Kolkey is informed about multiple incidents and safety concerns of the homeowners but is doing nothing to STOP Tracy Templin.

Based on recently received comments, every time Templin goes to harass these people he is also cynically sends "greetings from Neda Firouz" and the Board is doing nothing to STOP that. Why is TEMPLIN doing this? We have learned that Tracy Templin is terroarizing these peopel to make them leave Cross Creek Village. He is doing this to please unpopular manager Neda Firouz whose agenda is to clean up our reserve accounts and hurt this homeowner for discovering her kick-back deals with BINO Contractor which amounts to stealing.

CROSS CREEK VILLAGE MANAGER & CERTAIN BOARD MEMBER CAHOOTS SPONSORED HATE CRIME:

Acting under direct supervision of our manger, this allegedly unstable employee has reportedly committed varioushate crimes, ranging from assault and battery to criminal treats and vandalism of parked vehicles in the upper 'B' garage(the entire side and the vehicle hood was ruined - picture bellow). Yet thanks to Neda he is still working here and the assocation is providing no protection to homeowner in violation of HOA duty. Why? Because she needs for vendetas his unique intimidation/harassment service while the Board is playing games known as “we heard nothing about that".

RUTHLESS CCV LAWYER HARASSMENT OF BOARD MEMBER GERRY BRACE:

There has been number of reports of Discrimination and ongoing Intimidation and Harassment of homeowners [including Board Member Brace] since the arrival of our current manager about two years ago. To prevent Mr. Brace from exercising his fiduciary duty and to trump on his right to be the part of the decision making process, Adrain J. Adams, Esq INVENTED THE LAW. Thanks to our incompetent Board of Directors, manager's contract includes a half line tricky and contraversial provision stating "manager should have the right to contact attorney on behalf of the assocation".

This allows abusive manager to call daily abusive, brigand HOA lawyer Adrian J. Adams,Esq to harass, intimidate and bully homoewner/s into silence and capriciously fine and quash desent among politcaly active HOA members. [Read the LA Time Article linked above]

HARASSMENT OF OTHER HOA MEMBERS:

It has also been reported to CCV Alliance that Adrian J. Adams,Esq allready sent over 50 letters to one of our members and have billed us over $20,000 for that service and service fo coaching manager how to avoid legal compliance. As this member harassment serves no legitimate purpose this is clearly done to deny him the right to peaceful living, which we and the law are very much against for a logical reason.

When another homeowner asked to inspect assocation records Adams denied him this right also. For some copies he ask $2.00 per page to discurage request. Then he send him 3 letters for each received and he denied him over and over the legal right to force him to file claim in Small Claims' Court, to fleace up the HOA every inch of the way. Why is this Board allowing such "legal" abuse and mistretmant of homeowners? WE ASKED but they remained MUTE - (the only time they talk is when they ask for more money).

Why is Mr. Adams, "THE HOA LAWYER", doing this? To justify unjustifeble. To take large amounts of our budget money. To make you beleive that his outrageus fees and billings are necessary!!! - [NOTE: Lawyers are banned from Small Claims Court.]

TRUTH: You don't need lawyers to respond to homeowner's letters and Small Claims Court. That's manager's job. The Small Claims Court is design for easy and quick resolutions. Thus, our HOA should never pay outrageous Adrain J. Adams, Esq bills. Villa Riviera HOA in Long Beach refused to pay him when he submited tens of thousands in bills. Adams sue them for over $50,000. Hey, we use lawyer who sues his own clients!!! Can we trust this Board to make a one sound decisions? No we cannot!



He CLAIMS HE IS “PROTECTING HOA”… shure... so did Al Capone (lol). When harassing homeowners day after day with his rude, insolent and contemptuous letters, mostly women and poor people with foreign background, Adams is in fact forcing them to react so he can beging “protection” ... YES, it does sound like SCAM & the RACKET because we beleive it is a scam and it surely sounds awfully close to A-B-C of protection based "RACKETEERIGN". (click to read).

Please note that for the very same reason, we beleive, he prepaired and supported distribution of 14 pages homeowners slendering matterials yopu saw in January so to cause the lawsuit against the Cross Creek Village. Again, his goal is to "PROTECT" HOA, don't forget that. :) For the same reason we beleive he is protecting the above mentioned "striker" emplyee's criminal activities because these are darn sure to cause lawsuit against HOA ... it's horrible!

THIS ABUSE AND PROFIT DRIVEN "LEGAL RACKET" is also done for the purpose of creating hostile living enviroment in clear violation of his Civil Rights including Bane Act for which reason we, the homeowner association, might be found liable. As a result, our dues will go up. Do we want this? And why? Because Adams and the manager hate member's assertiveness and national background, and because in accordance with the law he/she did dare ask for copies of invoices and discovered ongoing racket with contractors? Is that democracy? Please NOTE that this scam is now widely known as “$1Million” Bino, Inc RACKET. If the management denies it ask them to show you comparative bids for $1Mill worth of construction. There is NONE. Zilch. Nada…

Adams on behalf of Association threatened the owner with a lawsuit, restraining order, suspension of privileges, and proceeded to fine the owner $200. every day for over 6 months."

ADRIAN J ADAMS ADJUDICATED HARASSMENT OF KRISTEN AUTRY:

Last year he did THE SAME THING to Ms. KRISTEN AUTRY, a Board member at Villa Riviera HOA in Long Beach, CA. And, this year is AGAIN doing the same thing to one of our momebrs. Because of this pattern of conduct we received a memebr comment that Mr. Adams shouldbe considered dangerous and unstable. “In all likelihood he was abused as a child and is now perpetually seeks victims to relief his internal pain”, received comment says.

Adrain J. Adams, Esq harassment of homeowner/s is forcing homeowner/s to ask court for help. Wouldn't you do the same if he star harassing you? In turn this trickster uses this as excuse to bill thousands of dollars, we was told. He told us in December he is defending the association from homeowner's "lawsuits". This is nonsense knowing that thanks to our nasty manager and gullible Board of Directors abuse of power THE ASSOCIATION IS THE ONE holding all the cards and all the power to harass homeowners USING OUR MONEY AGAINST US.

THE QUESTION IS: Why is CCV Board using this known abuser when they know he has homeowner harassing past? Power corupts. Probably our Board memebrs see this as 'quality' that will help them stay in power!

IF YOU DO NOT WANT TO RECEIVE DOZENS OF NASTY LETTERS FROM MR. ADAMS, BE HARASSED AND FINED CONTINUOUSLY BY SOME NASTY BOARD MEMBERS, DISCOVER YOUR VEHICLES KEYED REPEATEDLY – DON’T ASK FOR DOCUMENTS! - PAY YOUR DUES, DON’T ASK QUESTIONS, DON’T COMPLAIN, DON'T SHOW ON BOARD MEETINGS AND KEEP YOUR MOUTH SHUT WHEN YOU DON’T LIKE SOMETHING!

... OR VOTE FOR BOARD RECALL!!!
